Death and Taxes in NFIB v. Sebelius
Spurred by Chief Justice Roberts’s 2012 opinion in NFIB v. Sebelius, in which the Chief Justice found the so-called individual mandate invalid as an exercise of the Commerce Power but valid as an exercise of the Taxing Power, Professor Gowder explores the differences, if any, between commanding the performance of an act and taxing a person’s failure to perform that same act.
