Markets in Merger AnalysisIn this article, Professor Hovenkamp revisits the Supreme Court’s 1962 ruling in Brown Shoe Co. v. United States. He argues that, properly construed, Brown Shoe gives antitrust policymakers great latitude to develop merger-assessment methodologies that are not wedded to outdated and ill-advised market-definition concepts.
